Our services make it easier to transfer and receive cryptocurrencies into your wallet, saving you time and money. We are not liable (and shall have no responsibility to you) for any difficulties relating to the operation of the BitBlockAi or any node operated or maintained by BitBlockAi, including (but not limited to) sluggish network speeds and technical faults within the operation of the BitBlockAi. BitBlockAi   transactions are irreversible and cannot be revoked due to the nature of the Artificial intelligence wallet that's fully automated. If you transfer BitBlockAi (which includes the import of bitcoin from any offline wallet to any online wallet), please be informed that we reserve the right to charge the TX Fees listed below, whether or not the following conditions are met:

1. We were the ones who created the wallet.

2.The kind of wallet, such as whether it is an online wallet, an offline wallet, or any other sort of wallet, is specified.

3. Whether the wallets that are used for sending and receiving are maintained by the same individuals or by two different groups of people

3. If the contract is not completed by the specified end date, you will be charged a reconcilliation fee for the time your BitBlockAi wallet was inactive. This fee will be disclosed to you by the support team at the end of your contract.

The phrases "express or implied conditions," "warranties," "representations," and other terms that may apply to these Terms, the Services, or the Digital Content are expressly disclaimed to the fullest extent permitted by law.

Use of the Services and Digital Content is strictly prohibited unless and until you comply with all relevant laws. In addition, you agree not to obtain unauthorized access to, tamper with, damage, or disrupt any or all of the following information:

In order to make BitBlockAi more accessible, we provide services and digital material. This means that we do not act as their representatives, conduct investigations on their behalf, or enter into agreements on their behalf. You acknowledge and agree that we are not responsible for, and shall have no liability to you or any third party in connection with, any transaction you enter into through the Services or Digital Content. You also acknowledge and agree that we shall have no liability to you or any third party in connection with any acts or omissions of other users of the Services or Digital Content. In order to enter into a transaction with another user, you must first do your own due diligence and research.

We are not obligated to do anything as a result of these agreements.

Aside from the express terms of this agreement, all implied terms, whether statutory, common law, or otherwise, are hereby disclaimed. This disclaimer includes implied conditions, warranties, or other words relating to acceptable quality, fitness for purpose, or the exercise of reasonable skill and care.

If you have a disagreement with another user, we may (at our sole discretion) provide you with such assistance as we think appropriate in the circumstances; nevertheless, we will not be responsible for settling or mediating the dispute between you and that user. The user who is entirely responsible for such issues must be contacted directly to settle any complaints.

To the extent that it is not clearly stated differently in these terms and conditions, we assume no general or specific duty of care (whether fiduciary or otherwise) to you.

The term "Intellectual Property Rights" refers to all patents, utility models, rights to inventions, copyright and related rights, trademarks and service marks, trade names and domain names, rights in trade dress, goodwill, and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, and the right to maintain the confidentiality of information (including know-how and trade secrets), as well as any other intellectual property right.

In addition, you acknowledge that the Group owns all Intellectual Property Rights in and to the Services and Digital Content, as well as any supplementary software code or updates to them, and that you will have no other rights in or to the Services or Digital Content other than the right to use them in accordance with the terms of this Agreement.

Your obligations to us will continue to be in force, and our liability limitations will continue to be in place as set out in these conditions.

Before transferring your rights to a third party, you must first get our consent. Except with our explicit written consent, you may not transfer your rights or obligations under these terms.

It is important to note that we are neither partners nor agents on your behalf. This agreement is not intended to, nor should it be taken to be, the formation of a partnership or joint venture between us and you, nor does it constitute or imply that either we or you are acting as the agent of another party, or that either of us or you are authorized to enter into any agreements for or on behalf of any other party.

According to these standards, no one else is entitled to anything. Unless otherwise specified, this agreement is between you and us. No other person shall have the authority to enforce any of its requirements.

If a court determines that a part of these conditions is unenforceable, the remaining terms will remain in place. These interim agreement clauses operate independently of one another. The remaining paragraphs will remain legal even if a court or other relevant authority determines that any of them are unlawful.

However, we can always incorporate these requirements later if we postpone their implementation. Unless we require you to perform any of the obligations set out in these terms immediately, or if we do not take action against you for breach of this contract, this does not mean that you are not required to perform those obligations and does not preclude us from taking action against you at a later date under the terms of this agreement.

Apart from the English language, these terms may be translated into a number of other languages. Should any question arise in the interpretation (in a legal sense) of these terms between their translated equivalents, the English Language version shall be taken to be authoritative.

It is important to comprehend what laws apply to them and where they may file a lawsuit. If there is a dispute or claim arising out of or in connection with these terms, their subject matter or formation (including non-contractual disputes or claims), the dispute or claim shall be governed and construed in accordance with Belgian law, with the Belgian courts having exclusive jurisdiction to resolve the dispute or claim in conundrum.

 

PART 1: GENERAL APPLICATION

Account Setup (Step 1)

1.1. Account Setup: You must be at least 18 years old in order to use the BitBlockAi Services. 

 

1.2. Account Login: You must be at least 18 years old in order to log into a BitBlockAi wallet.

Terms and Conditions: We reserve the right to update or modify this Agreement at any time by posting a new version on the BitBlockAi Site and/or providing you with a copy of the revised Agreement (a "Revised Agreement"). The Revised Agreement will become effective immediately when it is published, but it will not apply retroactively in any way. By continuing to use the Services after the publication of a Revised Agreement, you acknowledge and agree to be bound by the terms and conditions of the Revised Agreement. If you are dissatisfied with any such change, your sole and exclusive remedy is to cease using the Services and cancel your account with the Company.

1.3. Create an account with BitBlockAi: You must first establish a BitBlockAi account in order to use the BitBlockAi Services (a "BitBlockAi Wallet"). BitBlockAi wallets are created with the promise and indication that they will be used only for personal purposes and not on behalf of any other party, unless BitBlockAi grants you prior permission to use them on their behalf. You are solely responsible for any and all activity that takes place via your BitBlockAi Wallet. The creation of a BitBlockAi Wallet is at the sole discretion of the BitBlockAi team, and we reserve the right to limit the number of BitBlockAi Accounts you may have, or to suspend or cancel any BitBlockAi Wallet or the trading of specific Digital Currency in your account, at any time and for any reason.

1.4. Verification of one's identity. Creating a BitBlockAi Account indicates your agreement to provide us with the information we require in order to verify your identity and to detect money laundering, terrorism funding, fraud, or any other financial crime, as well as your consent to allow us to retain a record of that information. Some verification criteria must be met before you may be granted permission to use the BitBlockAi Services. It is possible that your access to one or more BitBlockAi Services, as well as the limits on your use of the BitBlockAi Services, will be modified as a result of the continued collecting of information about you. You agree to notify us immediately if any of the information you provide changes in any way. When you provide us with your permission to conduct inquiries, directly or through third parties, as necessary to authenticate your identification or to protect you and/or us from fraud or other financial crime, you authorize us to take any action we reasonably believe necessary in response to the findings of such inquiries. Your personal information may be shared with credit reference, fraud prevention, or financial crime authorities when we do these queries, and you acknowledge and agree that these organizations may respond completely to our enquiries. A straightforward identity verification procedure, which should have no negative influence on your credit score, is being carried out. Additionally, you authorize your wireless operator (AT&T, Sprint, T-Mobile, US Cellular, Verizon, or any other branded wireless operator) to use your mobile number, name, address, email, network status, customer type, customer role, billing type, mobile device identifiers (IMSI and IMEI), and other subscriber status details, if available, solely for the purpose of verifying your identity and comparing the information you provided to BitBlockAi with the information provided to your wireless

1.5. Availability of resources. To make use of the BitBlockAi Services, you must have the appropriate equipment (such as a smartphone or laptop) as well as Internet access subscriptions in order to participate. Through the BitBlockAi Website, users may have direct access to the BitBlockAi Services. During instances of strong volatility or traffic, BitBlockAi services may undergo degradation or become unavailable. This may result in inability to acquire or sell for a period of time, as well as a delay in the response time of customer service representatives. The BitBlockAi Site and any BitBlockAi Services may be unavailable from time to time, and we make no warranty that any order will be completed, accepted, recorded, or that any order will remain open while we strive to provide great customer service. 2. Services for Wallets and Custodial Accounts (second paragraph)

2.1. The following services will be provided to qualified customers: (a) a hosted Digital Currency wallet(s) for the storage of Digital Currencies for staking or holding ("Digital Currency Wallet"), and (b) an Ai-enabled wallet to keep your crypto assets safe with the integration of an automated hosted US Dollars ("USD") wallet ("Ai-enabled Wallet").

2.2. A digital currency wallet that is hosted on a third-party server: Your Digital Currency Wallet provides you with the ability to store, manage, and track your Digital Currency stakes or holdings in one convenient location. "Digital Currency" refers to just those digital currencies that have been defined as being available for trade or custody in your BitBlockAi Wallet, and this is the case throughout this document (also known as "Supported Digital Currency"). Depending on the jurisdiction, the services and underlying assets may be different. We use a combination of online and offline storage to safely store Digital Currency private keys, which are required in order to conduct transactional transactions. If, as a result of our security protocols, we are required to retrieve private keys or other related information from offline storage in order to facilitate Digital Currency Transfers, you acknowledge that this may result in a delay in the initiation or crediting of such Digital Currency Transfers, and you agree to accept the risk that such a delay will occur. Additionally, you may opt to make use of additional services, such as the BitBlockAi Vault, which allows you to choose withdrawal timings and other rules controlling the safety and transfer of your Digital Currency. In the case of such a product(s) and service, additional rules may apply (s). Once your staking of the smart hodl plan is complete, you will get an email with your private key for withdrawal.

2.3. Digital Currencies that are accepted by the system Creating a BitBlockAi account is only for the purpose of utilizing the Site's supported digital currencies in an appropriate manner. Under no circumstances should you attempt to use your Digital Currency Wallet to store, transmit, request, or receive digital currencies that we do not support or that we do not support. BitBlockAi expressly disclaims any and all responsibility for any attempts to use your Digital Currency Wallet with a coin that we do not now support. 2.4. Protocols for supplemental treatment are not included. According to the BitBlockAi website or any formal public announcement by BitBlockAi, Supported Digital Currencies excludes any additional protocols and/or capabilities that complement or interact with the Supported Digital Currency, unless otherwise noted. We do not support any Digital Currency that contains or interacts with any metacoins, colored coins, side chains or other derivative or forked protocols, tokens, or coins, including but not limited to staking, protocol governance, and/or any smart contract functionality that may supplement or interact with a Digital Currency we do not support. Don't use your BitBlockAi Account to attempt to accept, request, send, store, or engage in any other kind of transaction or activity using any such protocol, since BitBlockAi is not configured to detect, secure, or manage such transactions and functionality. Any transaction involving such items will result in the loss of the item in question. Furthermore, you understand and acknowledge that additional protocols are not included in the list of Supported Digital Currencies, and that BitBlockAi is not liable for any damages that may arise as a consequence of the use of supplementary protocols.

2.5 Protocols for Digital Currencies Technical Operation: We do not own or administer any of the software protocols that are used to regulate the operation of the Digital Currencies listed on our website. The underlying protocols are, for the most part, open source, which implies that they may be used, copied, updated, and distributed by anybody at any time. We accept no responsibility for the operation of the underlying protocols and are unable to guarantee the functionality or security of the network in any way. The operating rules of the underlying protocols, in particular, may be subject to sudden modifications (including "forks"). Availability, value, functionality, and/or the name of the Digital Currency held in your Digital Currency Wallet may all be affected by any substantial operational changes that occur in your digital currency wallet. No effect on the timing or nature of any significant operational modifications can be attributed to BitBlockAi. When considering whether to continue using a BitBlockAi Wallet for the affected Digital Currency, it is your responsibility to keep updated about planned operational changes and to carefully balance publicly accessible information and information offered by BitBlockAi. A material operating change will be communicated to you by BitBlockAi using reasonable efforts; however, BitBlockAi will not be responsible for any changes that occur as a result of circumstances beyond its control. BitBlockAi will use reasonable efforts to communicate with you about any material operating change; however, BitBlockAi will not be responsible for any changes that occur as a result of circumstances beyond BitBlockAi's control. According to BitBlockAi's discretion, the company may choose whether or not to support a new digital currency, fork, or other action in the event of a significant operational change. If you are a Bitcoin miner, you acknowledge and accept the risks connected with operational changes to Digital Currency protocols. You also acknowledge and agree that BitBlockAi is not accountable for any loss of value you may experience as a result of such changes. You acknowledge and accept that BitBlockAi has the right to choose its response to any operational change, and that we are under no obligation to assist you with currencies or protocols that are not currently supported.

2.6.0 As explained below, BitBlockAi stores all digital currencies in your Digital Currency Wallet as custodial assets for your benefit, and you retain ownership of those currencies.

2.6.1 Possession: Digital Currency shall remain your property at all times and will not be transferred to BitBlockAi or any other third party. You are completely responsible for any Digital Currency that you have in your Digital Wallet as the owner of that Digital Currency. BitBlockAi will not be held liable for any changes in the value of a digital currency. BitBlockAi does not own any of the Digital Currencies in your Digital Currency Wallet, and none of the Digital Currencies in your Digital Currency Wallet will be loaned to BitBlockAi; BitBlockAi does not represent or treat the assets in Users' Digital Currency Wallets as its own. BitBlockAi does not guarantee that the Digital Currency in your Digital Currency Wallet will be available when you need it. Except as required by a facially reasonable court order or as otherwise mentioned above, BitBlockAi will not sell, transfer, loan, hypothecate, or otherwise alienate Digital Currency held in your Digital Currency Wallet unless you directly request that we do so, in which case we shall comply.

 

2.6.2 Command: Subject to outages, downtime, and any other applicable rules, you have the option to withdraw your Digital Currency at any time by moving it to a different blockchain address when your mining cycle is complete. As long as you continue to store your Digital Currencies with BitBlockAi, BitBlockAi will retain ownership of the electronic private keys associated with the blockchain addresses controlled by BitBlockAi, which includes the blockchain addresses where your Digital Currencies are stored. BitBlockAi will also retain ownership of the electronic private keys associated with the blockchain addresses controlled by BitBlockAi.

2.6.3 Acknowledgement of Risk: You acknowledge that Digital Currency is not protected by the protections or insurance provided by the Federal Deposit Insurance Corporation or the Securities Investor Protection Corporation, respectively.

2.6.4 Unsegregated Digital Currencies: In order to ensure the security of customers' and/or BitBlockAi's assets, BitBlockAi may use shared blockchain addresses managed by BitBlockAi to store Digital Currencies held on behalf of customers and/or BitBlockAi.

 

2.6.5 Unsegregated Digital Currencies: In order to ensure the security of customers' and/or BitBlockAi's assets, BitBlockAi Despite the fact that we maintain separate ledgers for Client and BitBlockAi accounts, BitBlockAi is under no obligation to separate Digital Currencies held by you from those held by other customers or by BitBlockAi based on their blockchain addresses.

2.7. The amount of money in your wallet in US dollars. You may use your USD Wallet to store and transfer USD using your BitBlockAi Account, as described further down this page. Generally, we will combine your USD Wallet balance with the balances of other users and either hold the funds in a custodial account at an FDIC-insured bank in the United States or invest them in liquid assets such as US Treasury bonds, in accordance with applicable state money transmitter regulations. BitBlockAi is the owner of the interest or other earnings generated by these assets. Customer funds are kept separate from BitBlockAi corporate funds, and BitBlockAi will not use them to cover operating expenses or for any other purposes related to the company's operations.

 

2.8. You may also acquire USD Coin through BitBlockAi, a Digital Currency that is fully collateralized by the US Dollar and approved by Circle Internet Financial, as an alternative to purchasing USD Coin ("Circle"). The USDC Wallet balance belongs to you alone; no one else has it. BitBlockAi is not the issuer of USDC, does not maintain a reserve of US Dollars for USDC holders, and is under no obligation to buy your USDC for US Dollars if you no longer choose to keep them. BitBlockAi may also purchase your USDC in exchange for US dollars, and Circle lets you redeem your US dollars. Circular USDC Agreement (available at https://support.usdc.circle.com/hc/en/articles/360001233386-Circle-USDC-User-Agreement) imposes extra obligations, commitments, and limitations on USDC, and you agree to be bound by the terms of that agreement.

2.9 A single-click offer to obtain a number of Digital Currencies, subject to our current Bundle buying pricing, is provided by the BitBlockAi wallet Performance Percentage ("The percentage increase determines profit and keeps the wallet active"). In order for your smart Hodl or staking strategy to be successful, the Performance Percentage must be at least 50%. BitBlockAi has the right to make the Digital Currencies included in any campaign available to the public at its own discretion. The amount of any Digital Currency included in any offer is proportional to the "market capitalization" of that currency, which is calculated by multiplying its current price by the number of Digital Currency in circulation at that time. In order to take advantage of a promotion, you must understand and agree that you will only be able to sell and transmit any Digital Currency included in the promotion after you have finished your smart Hodl or Staking strategy. Only once you have finished your smart Hodl or Staking plan will BitBlockAi enable you to sell a quantity equally across all Digital Currencies acquired as part of the promotion. 3. Payment Services, Purchasing, Selling, and Swapping are all included.

3.1. In the United States of America, funds are held in a trust. You may fund your USD Wallet by making an ACH or wire transfer from a bank account that has been verified. Your USD amount is pending, and it will not be credited to your USD Wallet until the bank transfer has been received and cleared, which generally takes five to seven business days. It is necessary that your purchase comply with the specifications set out on the BitBlockAi website. In the event that you do not confirm any transaction within five (5) seconds of the transaction price being stated by BitBlockAi, BitBlockAi has the right to discontinue the transaction. A purchase of Digital Currency made via the use of a Valid Payment Method is normally completed the next business day after we receive your purchase instructions from you. In the case of a bank account or credit or debit card, purchased Digital Currency will be placed in your Digital Currency Wallet as soon as the money has cleared with BitBlockAi, which may take up to five working days in the case of a bank account. You may sell Digital Currency and instruct BitBlockAi to deposit the proceeds into your BitBlockAi USD Wallet or a Digital Currency Wallet, if such a feature is available. In this document, the terms "Digital Currency Transactions" and "Digital Currency Purchases and Sells" refer to the purchases and sales of digital currencies as a group. For whatever reason (for example, price volatility, Pro's failure to respond, or an order exceeding the maximum order size), BitBlockAi will reject your Digital Currency Transaction and notify you that the transaction has been rejected by BitBlockAi. In the event that your transaction is refused, you will not be charged.

3.3. Charges are the third item on the list. We make money in general by providing digital currency services to our visitors, who may then purchase, stake and trade digital currencies as well as operate a smart Hodl plan on our website. By utilizing BitBlockAi Services, you acknowledge and accept that you will be responsible for any and all fees and costs that may be incurred. It is the sole and absolute discretion of BitBlockAi to adjust its pricing and fees at any time, as well as any applicable waivers. 3.4. Transactions in Digital Currency that occur on a recurring basis. Recurring Digital Currency Transactions provide us permission to make recurrent electronic payments in line with the Digital Currency Transaction and any connected payment accounts, such as recurring automated clearing house (ACH) debit or credit entries from and to your linked bank account. As long as you or BitBlockAi does not cancel the repeating purchase, your recurrent transactions will occur in identical, periodic quantities according to the period you pick (daily, weekly, or monthly). The ACH credit or debit will be processed on the following business day if you choose a US Bank Account as the payment method for a recurring transaction and the transaction takes place on a weekend, a holiday, or after bank business hours. However, the Digital Currency fees associated with the regularly scheduled transaction will apply. If your bank is unable to process any electronic ACH debit entry, we will notify you of the cancellation and may pursue any payments owed to BitBlockAi in accordance with the procedures outlined in this User Agreement. If your bank is unable to process any electronic ACH debit entry, we will notify you of the cancellation. This authorization will remain in place until you either adjust your recurring transaction settings or tell us in writing at Contact Support that you no longer want to have your information collected. Before the commencement of any recurring transaction, you agree to tell BitBlockAi in writing of any changes to your bank account information that you have linked to your account. BitBlockAi has the right to terminate recurring transactions at any moment by providing you with notice.

3.5. Cancellation. When you give us permission to acquire (buy) Digital Currency, you are unable to rescind your consent unless the transaction is not scheduled to take place until a later date, such as if you have set up a recurring purchase of Digital Currency for us to make (a "Future Transaction"). Once the transaction has been completed, you will not be able to rescind your authorization. It is necessary to finish your Staking or Smart Hodl plan in order to withdraw your agreement.

3.6. Transactions that are incorrect or unauthorized. When a Digital Currency or USD transaction is conducted using your credentials, we will presume that you have approved the transaction until you inform us otherwise. Please tell us through email at Contact Support if you believe that you did not provide your approval for a certain transaction or that a transaction was carried out in an incorrect manner. It is vital that you check your USD Wallet and Digital Currency Wallet balances on a regular basis, as well as your transaction history, to ensure that you notify us as quickly as possible if any transactions seem to be unlawful or erroneous in any way. Without your prior notification in compliance with this section, we will not be held responsible for any claims related to unlawful or erroneous transactions.

3.8. You provide your consent to the access, processing, and storage of your personal data. When you use BitBlockAi Services, you acknowledge and agree that we may access, handle, and keep any personal information you provide us with in order to provide you with such services. Neither we nor you have any rights or obligations under relevant data protection, privacy, or other laws and regulations, and this authorization has no influence on any of such rights or obligations. By canceling your account with us after the conclusion of your mining cycle, you have the option to withdraw this authorization at any time. We do, however, retain the right to preserve and use your personal information for other purposes in the future.

3.9. Reversals and cancellations are covered in this section. You will not be able to cancel, reverse, or change any completed or continuing transaction after it has been completed. Your payment is unsuccessful, your payment method does not have sufficient funds, or you reverse a payment that was made from funds in your bank account, you authorize BitBlockAi to cancel the transaction or to debit your other payment methods, including your USD Wallet or Digital Currency Wallet balances or other linked accounts, in any amount necessary to complete the transaction, including your linked accounts. The responsibility for maintaining an acceptable balance and/or credit limits is with you in order to avoid incurring overdraft, non-sufficient funds (NSF), or other similar penalties from your payment processor. We reserve the right to refuse to process, or to cancel or reverse, any Digital Currency Transactions or Transfers in our sole discretion, even after funds have been debited from your account(s), if we suspect the transaction involves (or has a high probability of involving) money laundering, terrorist financing, fraud, or any other type of financial crime; in response to a subpoena, court order, or other government order; or if we reasonably suspect the transaction is espionage-related or fraudulent As a result, BitBlockAi will reverse the transaction, and we are under no obligation to allow you to resume a purchase or sell order at the same price or under exactly the same circumstances as the transaction that was previously reversed.

3.10. Restrictions.  BitBlockAi makes it simple to invest in and acquire cryptocurrencies in a safe and secure environment. Please bear in mind that you will not be able to cancel any current plans. The deposits and profits earned under a contract cannot be used to establish a new contract with the same party. There is also a small changeable cost connected with Coin Swap that is worth noting. 3.12 Referrals are handled in accordance with company policy. 4. Transfer of cryptocurrency.

Aesthetics:   If your identification has been properly validated, your Digital Currency Wallet will allow you to send Supported Digital Currency to third parties as well as request, receive, and store Supported Digital Currency from third parties through the BitBlockAi Website, if your identification has been appropriately validated. Whenever you transmit or receive Supported Digital Currencies between your other digital currency wallets (including wallets that are not housed on the BitBlockAi Site), as well as to and from third parties, you are engaging in a "Digital Currency Transfer."

4.3 Transactions that are presently in the process of being completed. Once a Digital Currency Transfer has been sent to a Digital Currency network, it will remain unconfirmed and in a pending state until the Digital Currency network verifies the transaction has been successfully completed. An uncompleted transaction is defined as one that is still in the pending stage. For any pending digital currency transfers started from a BitBlockAi Account, the transaction status will be shown as "pending transaction" and the account will be inaccessible for use on the BitBlockAi platform or in any other capacity while the transaction is in progress.

 4.4 Transfers of digital currency from countries other than the United States. It is the person initiating the transaction who is solely responsible for properly executing the transaction, which may include paying sufficient network or miner fees to ensure the transaction's success. When you or a third party sends Digital Currency to a BitBlockAi wallet from an external wallet that is not hosted on BitBlockAi ("Outbound Transfers"), BitBlockAi is not responsible for the transaction. It is possible that an Inbound Transfer will be held in a pending state due to insufficient network fees. BitBlockAi is not responsible for any delays or losses that may occur as a result of an error in the transaction's initiation, and we have no obligation to assist in the remediation of such transactions. In order to initiate an Inbound Transfer, you must first confirm that you are dealing in a Supported Digital Currency that is compatible with the BitBlockAi wallet to which the money is being sent. You may confirm that you are initiating an Inbound Transfer of Ethereum only by choosing an Ethereum wallet address to receive payments, as opposed to Bitcoin or Ethereum Classic, by selecting an Ethereum wallet address to receive payments. For any unsupported digital currencies that are transferred to a BitBlockAi Account, or for any supported digital currencies that are delivered to an incompatible digital currency wallet, BitBlockAi bears no responsibility. Funds that have been sent in mistake will be forfeited by the sender. We recommend that customers first send a small quantity of Supported Digital Currency as a test before proceeding with a larger transmission of Supported Digital Currency, as described above. BitBlockAi has the right to modify the types of Digital Currency that are supported from time to time without notice.

4.5 Transfers of digital currency from one location to another When you transfer Digital Currency from your BitBlockAi Account to an external wallet ("Outbound Transfers"), BitBlockAi will carry out your instructions and complete the transfer on your behalf. You should double-check all of the transaction data before giving us instructions. BitBlockAi has no responsibility or duty for blockchain destination addresses that are input wrongly. We make no assurances on the identity or value of the receiver of an Outbound Transfer. After being broadcast to the proper Digital Currency network, digital currency transfers are irreversible; nevertheless, while the transaction is being completed by network operators, the transfer may be in a pending state and designated as such by the network. When you reach the end of your hodl or staking plan, the withdrawal procedure on a PRO wallet will take a minimum of fourteen days and a maximum of twenty-one days to be completed on your request. In order to commence a high priority withdrawal procedure, you must make an additional deposit, the amount of which will be given to you at the conclusion of your contract.


4.6 It should be noted that BitBlockAi has no control over the Digital Currency network and thus makes no guarantees or warranties on the network's confirmation of a Digital Currency Transfer. Any pending Outbound Digital Currency Transfers may be refused or canceled if directed to do so by a court of law, a court of appeal, or any other authority to which BitBlockAi is subject in any jurisdiction. Moreover, after completing a transaction, we may require you to wait a set length of time before enabling you to use additional BitBlockAi Services and/or engage in transactions in excess of the given volume restrictions.

4.7 Transfers to a Recipient's email address (if one exists). BitBlockAi allows you to execute a Digital Currency Transfer to a customer by providing the customer's email address in the program's settings. Whenever you send a Digital Currency Transfer to an email address, we will invite the recipient to register a BitBlockAi account. Upon failure of the recipient to create a BitBlockAi Account within 30 days, we shall credit your Digital Currency Wallet with the appropriate Digital Currency in our discretion.

4.8 Non-affiliated merchants are those who do business with the corporation. It is understood that we have no control over, and accept no responsibility for, any aspect of any items or services you may purchase from a third party, including delivery, quality, safety, legality, or any other factor (including other users of BitBlockAi Digital Currency Services). We make no representations or warranties that a third-party buyer or seller with whom you interact will complete the transaction or that they are legally permitted to do so. If you have a problem with any products or services you have purchased or sold to a third party using Digital Currency transferred through the BitBlockAi Digital Currency Services, or if you have a disagreement with a third party, you should take care of the problem directly with that third party, not through the BitBlockAi. if you believe that a third party has acted fraudulently, deceptively, or inappropriately, or if you are unable to resolve a disagreement with a third party effectively, you should contact BitBlockAi Support at Contact Support so that we can determine the best course of action for you.

4.9. Obligations in terms of money. The BitBlockAi Reserves its right to debit your BitBlockAi Account or BitBlockAi Pro Account and/or to withhold amounts from funds transferred from your BitBlockAi Account to your BitBlockAi Account if any amounts owed to us hereunder remain unpaid, including amounts owing in your BitBlockAi Account. To be eligible for withdrawal, all mining charges, trade fees, tax fees, and bank transfer fees must be paid at the end of the mining cycle in order to be eligible for withdrawal.

 

5. Service Extensions and Supplementary Services


5.1. The following services ("Additional Services") may be made available to customers who fulfill certain eligibility requirements in addition to the Services specified above by BitBlockAi.

5.2. Services for BitBlockAi Pro  Service given by BitBlockAi Pro in connection with the order matching platform provided by BitBlockAi Pro are referred to as BitBlockAi Pro Services. To use the BitBlockAi Pro Services, you must first establish a BitBlockAi Pro account by making an investment of up to 5 bitcoins. If you match the eligibility conditions, you may use the services immediately ("BitBlockAi Pro Account"). It is understood that the requirements of this Section 5.1. are in addition to the other elements of this Agreement, including but not limited to the release, indemnity, disclaimer, limitations of liability, prohibited uses, dispute resolution procedures, and cancellation policies set out above. Furthermore, you recognize and agree to be bound by the BitBlockAi Pro Trading Rules and Trading Fees, which you have read and understand.

5.2.1 Create a BitBlockAi Pro user account. You are not permitted to sell, lease, provide, or otherwise offer access to your Trading Account to any other business or person who is not an employee or agent of your company or who is not a customer of your company. You acknowledge and agree that you are solely responsible for the use of BitBlockAi Pro by your employees or agents, whether they access it directly via the BitBlockAi Pro website or through other ways, such as those provided by API keys and/or applications that you may approve. You acknowledge and agree that you are solely responsible for any orders, trades, and other instructions placed into BitBlockAi Pro, as well as for any identifiers, permissions, passwords, and security codes associated with your BitBlockAi Pro Account, and that you are solely responsible for any orders, trades, and other instructions placed into BitBlockAi Pro. 


5.2.2 Order Books: BitBlockAi Pro Services provides an order book for a number of digital and fiat currency trading pairs, as well as for a variety of cryptocurrency trading pairings (each an "Order Book"). To acquire a BitBlockAi Pro wallet activate a 6-9 months Hodl plan or activate a staking plan.

5.3 Reward Points

CRYPTOCURRENCY IS A DIGITAL CURRENCY, AND BitBlockAi DOES NOT HAVE THE RIGHT TO USE ANY CRYPTOCURRENCY YOU STORE ON BitBlockAi IF YOU DO NOT GIVE IT TO US. BitBlockAi is not a depository institution, and your cryptocurrency wallet is not a depository account, either. Your wallet is fully automated and you are in control of your wallet security and performance percentage.

5.3.1 Admissions requirements must be met. If you meet the requirements, you may be eligible to get rewards for holding or staking cryptocurrencies on BitBlockAi.com. In the "Calculation" section below, you will see that as long as you have at least $500 USDC in your BitBlockAi.com account, you will automatically earn cryptocurrency in the amounts mentioned belIn the event that you do not have have at least $500 worth of cryptocurrencies in your account at any point in time, your smart Hodl Rewards enrollment will be suspended until you do have at least $500 worth of cryptocurrency in your wallet on BitBlockAi.com. During this period, you will be able to retain any Rewards that have been acquired but have not yet been granted. Such accumulated incentives shall be distributed in line with the "Calculation" portion of this document. If you are found to be ineligible at any time during your participation in USDC Rewards, your enrollment will be terminated in a similar manner. At any time, you may choose to opt-out of Rewards or rejoin it by following the procedures outlined below. It is your decision whether or not to stop Rewards or to cancel your BitBlockAi.com account, and you will lose all rewards you have accrued up to that moment (that have not yet been given for the current calendar month) and invested capital as wallet activity must be completed to activate withdrawal operations . Cryptocurrencies  that have been used to run a Smart Hodl plan on BitBlockAi Pro are eligible to be used for cryptocurrency Staking once the Hodl plan is completed.


5.3.2 Calculation: Daily rewards are acquired in the form of cryptocurrency at the then-current reward rate, which is based on the longevity of your plan.  We may estimate our current yearly percentage return on rewards, which includes the influence of monthly compounding. Your BBAitaticmier.com cryptocurrency wallet is credited with earned rewards on a daily basis.   Daily Amount Method: We compute the rewards you get on a daily basis based on your average USDC balance for the day, which is equal to your average USDC balance for the day. It is the then-current Smart Hodl or Staking rewards rate divided by 365 that is used to determine the amount of rewards earned on any particular day.

5:3.3 Modifications: We reserve the right to make changes to the Smart Hodl or Staking Rewards Rate Daily Percentage Yield at any time by contacting you here and here, as well as by any other appropriate mode of communication (including e-mail). The notification does not take effect until the first day of the calendar month following receipt of the notification, unless otherwise mentioned in the notification. We reserve the right to alter, modify, or delete any aspect of these terms and conditions at any time, as well as to discontinue the Smart Hodl or Staking rewards program or your participation in it, by notifying you in the same manner as described above.

5.3.4 Compendium of references

It is the daily rate of rewards earned on a cryptocurrency wallet that is referred to as the "Rewards Rate." This rate is not compounded and is expressed as a percentage.

An annual percentage rate representing the entire amount of Rewards earned over a 365-day period, computed using the then-current Rewards Rate and monthly compounding over a 365-day period, is referred to as the "Rewards Annual Percentage Yield" or "APY." This method is referred to as the "Daily Balance Method" because it applies the daily periodic rate (derived from the APY) to the calendar day average of USDC saved in your USDC wallet on an ongoing basis.

Unless otherwise specified, the word "day" refers to a calendar day as defined by the Universal Time Coordinated Coordinated System.

5.4 Staking Terms. In the event that you have Digital Currencies on BitBlockAi, you have the option to "stake" them in the staking services provided by BitBlockAi. A proof of stake network is one in which the transaction validators are chosen based on their ownership of the underlying Digital Currency rather than their computing capability (i.e., proof of work). Please see our stacking information page for further information on how proof of stake works and how it is implemented.

5.4.1 Staking Service is an optional service. BitBlockAi provides access to staking services for all Digital Currencies that are supported by the software by default. IF YOU DON'T WANT TO STAKE WITH BitBlockAi, YOU MAY DO SO, BUT YOU WILL NOT BE ABLE TO STOP THE BitBlockAi STAKING SERVICES ONCE THEY ARE ACTIVATED.

5.4.2 The Service; the Benefits; the Commission; and the Restrictions As part of our service, BitBlockAi will stake your assets on your behalf with our Ai-enabled wallet, which will act as a transaction validator on the network for which you stake your Digital Currency.   If BitBlockAi successfully validates a block of transactions in a Digital Currency, it may be rewarded by the network that runs the Digital Currency in which it is running. The protocols of the relevant network will determine how much money you will get. Upon receipt of your payment, BitBlockAi will send this reward to you after deducting a 12% processing charge. A "slashing" penalty is imposed on staked assets if the transaction validator representing those assets incorrectly confirms a transaction on some Digital Currency networks. If your assets are sliced, BitBlockAi will make commercially reasonable efforts to prevent this from happening; nevertheless, in the unlikely event that they are, BitBlockAi will replace them swiftly and at no additional cost to you. During the staking procedure, many Digital Currency networks require that a certain amount of staked assets be locked (i.e., not accessible for sale or transfer) in order to avoid a transaction fee. Additional limits on the sale or withdrawal of certain staked assets may be imposed by BitBlockAi if you have chosen to participate in staking.

5.4.3 There can be no certainty in this regard. Your claim on the prize is not valid until BitBlockAi has received it. BitBlockAi will credit your wallet with the prizes as soon as they are received by the software. BitBlockAi will make commercially reasonable efforts to stake any Digital Currencies for which you make use of our staking services in accordance with applicable laws. In the case of a given Digital Currency, the "staking rewards rate" stated by BitBlockAi is an annualized historical rate calculated based on the staking rewards produced by BitBlockAi in the previous 90 days while providing staking services to BitBlockAi clients for that Digital Currency. This is a tentative rate that may change at any time. In no way does BitBlockAi guarantee that you will get static rewards, any specific static reward, or any static return over time, including the rate at which you will receive static rewards. In no way does BitBlockAi guarantee that you will receive static rewards.

6. Information and data privacy and security

6.1. Information that may be used to identify an individual. If you are an individual, you acknowledge and agree that we may handle personal data about you (if you are an individual), as well as personal data about your employees and any related or other persons that you have supplied or will supply to us in connection with this Agreement or the BitBlockAi Services in the future. You represent and warrant that: I any personal data you provide to us about individuals other than yourself was or will be provided in accordance with all applicable data protection and data privacy laws, and that the information you provide is accurate, current, and relevant at the time of disclosure; (ii) prior to providing any such personal data to us, you have read and understood our Privacy Policy, which is available; and (iii) in the case of personal data relating to children, you have read and understood our Children's Privacy Policy

6.2. Infraction of Security.  If you have reason to believe that your BitBlockAi Wallet or any of your security details have been compromised, or if you become aware of any fraud or attempted fraud, or any other security incident (including a cyber-security attack) affecting you or BitBlockAi (collectively, a "Security Breach"), you must immediately notify BitBlockAi Support via free email at Contact Support or by calling +44 You are responsible for taking all reasonable steps to minimize, manage, and report any Security Breach that occurs. Failure to inform us of a Security Breach within a reasonable amount of time may be taken into consideration when determining the appropriate response.

7. Generally Acceptable Use, Prohibited Use, Death of the Account Holder, and Termination of the Account

7.1. A license having a time restriction on its validity. In consideration of your acceptance of the terms and conditions of this Agreement, we grant you a limited, nonexclusive, non transferable license to access and use the BitBlockAi Services, the BitBlockAi Webpage and associated content, materials, and information (collectively, the "Content") solely for the purposes that BitBlockAi has approved from time to time. Any other use of the BitBlockAi Site or Content is strictly prohibited, and all other rights, title, and interest in and to the BitBlockAi Services, BitBlockAi Site, and BitBlockAi Content are reserved exclusively for BitBlockAi and its licensors. BitBlockAi reserves all rights, title, and interest in and to the BitBlockAi Services, BitBlockAi Website, and BitBlockAi   You agree not to duplicate, transmit, distribute, sell, license, reverse engineer, alter, publish, participate in the transfer or sale of, create derivative works from, or otherwise exploit any of the Content, in whole or in part, without BitBlockAi's prior written authorization. BitBlockAi reserves the right to terminate your access to the Content at any time. In addition to BitBlockAi.com, BitBlockAi Pro, and any other logos affiliated with the BitBlockAi Services or visible on the BitBlockAi Website, BitBlockAi and its licensees own and/or use trademarks or registered trademarks in their respective countries. You may not reproduce, replicate, or use them unless you have obtained BitBlockAi's prior written agreement. 

 7.2. Websites' accuracy:  The BitBlockAi Website (including, without limitation, the Content) may include technical inaccuracies or typographical errors, despite our best efforts to provide accurate and up-to-date information on the BitBlockAi Website (including, without limitation, the Content). Information regarding our policies, products, and services may be revised or modified from time to time without notice in order to provide you with the most up-to-date and accurate information available. Therefore, you should double-check any information before relying on it, and any decisions you make based on the information included on the BitBlockAi Website are completely your responsibility, and we shall have no liability in this regard. Third-party data, such as historical price and supply figures for Digital Currencies, is provided only for the purpose of providing information, and BitBlockAi provides no warranties or claims about the accuracy of the information. Links to third-party material (including, but not limited to, websites) are provided for your convenience, but we have no control over it and cannot guarantee its accuracy. You acknowledge and agree that we are not liable for any portion of the information, content, or services included in third-party materials or on third-party websites accessible via or linked to from the BitBlockAi Website, and that we have no control over such materials or websites. 


7.3. Promotions: BitBlockAi may provide special promotions or special offers to qualifying customers on a limited basis from time to time. Depending on the circumstances, BitBlockAi or the issuer of a Digital Currency that is the subject of an offer or promotion may, in its sole discretion and in accordance with applicable legislation, establish eligibility conditions for participation in a particular campaign. BitBlockAi has the right to discontinue any special offer at any time and without prior notice. In the event that digital currency is deposited in a user's Digital Currency Wallet, the digital currency is considered to be the user's property, and the user is entitled to all applicable property rights, including those set out in Section 2.2 of this Agreement. BitBlockAi is under no obligation to provide special discounts to all of its customers. BitBlockAi expresses no opinion on the value or utility of any Digital Currency that is the subject of a campaign and makes no recommendation or recommendation.

 

 7.4. Applications submitted by third parties.  Whether via a third party's product or service, or directly through the BitBlockAi website, you recognize that providing authorization to a third party to do particular acts on your behalf does not relieve you of any of your duties under this Agreement. You are solely responsible for the acts and omissions of any third person who acquires access to your BitBlockAi Wallet via your fault or negligence (s). Further, by using BitBlockAi, you acknowledge and agree that BitBlockAi will not be liable for any liability arising out of or related to any act or omission of any third party who has access to your BitBlockAi Wallet, and that you will indemnify BitBlockAi from liability arising out of or related to any act or omission of any third party who has access to your Wallet on BitBlockAi's behalf (s). Any permissions granted to third parties in respect to your BitBlockAi Wallet (s) may be modified or deleted at any time by visiting the Account Settings page on the BitBlockAi Site and selecting the appropriate option.

7.5. Use is strictly prohibited. With respect to your use of the BitBlockAi Services, as well as your interactions with other users and third parties, you agree and represent that you will not engage in any Prohibited Business or Prohibited Use as specified above. At all times, we retain the right to monitor, review, preserve, and/or disclose any information as necessary to comply with any applicable law, regulation, sanctions program, legal process, or governmental request, and we will do so without notice. The right to terminate and/or suspend your BitBlockAi Wallet(s), block transactions, and/or freeze money exists at all times and without notice if we determine that your Wallet is associated with a Prohibited Use and/or a Prohibited Business, and we do so without prior notice.

7.6 Transactions are subject to certain restrictions. In order to use any BitBlockAi Services, you must adhere to a volume limit, which is represented in US Dollars, on the total amount of volume you may trade or transfer in a given period (e.g., daily). To check your limitations, log into your BitBlockAi wallet. Your wallet performance percentage determines limitations.   Depending on the payment method you pick, the verification steps you complete, and other circumstances, your transaction limits may differ. All withdrawals on any account are subject to a 10 percent -15 percent payment of total returns, depending on the contract you choose, to cover all Staking or Smart Hodl plan expenditures and tax charges accumulated to the plan prior to withdrawal. A neutral arbitrator, rather than a judge or a court, should handle all of these types of disagreements. Broadcasting Company BitBlockAi retains the right, in our sole discretion, to amend the applicable limits. If you want to extend your restrictions over and above the amounts indicated, please submit a request at Contact Support. We may ask for further information about you or your firm, as well as the submission of papers and the scheduling of meetings with BitBlockAi representatives (such process, "Enhanced Due Diligence"). The BitBlockAi Investment Platform has deposit and withdrawal limits that apply to transactions.

7.7. Contracts may be suspended, terminated, or canceled under certain circumstances. (a) BitBlockAi may suspend, restrict, or terminate your access to any or all of the BitBlockAi Services; and/or (b) deactivate or cancel your BitBlockAi Account(s) if any of the following circumstances apply: 
 (i) we are required to do so by a facially valid subpoena, court order, or binding order of a government authority; 
(ii) we are required to do so by a facially valid subpoena, court order, or binding order of a government authority; 
(iii) Your BitBlockAi Account(s) is subject to any active lawsuit, inquiry, or government process and/or we believe there is an increased risk of legal or regulatory non-compliance linked with your Account activity;
(iv) Our service partners are unable to support your use; 
(v) you engage in any activity that BitBlockAi deems to be a circumvention of BitBlockAi controls, including but not limited to opening multiple BBAitaticmier Accounts or abusing promotional offers that BBAitaticmier may make from time to time;


When it suspends or shuts down your account or terminates your use of BitBlockAi Services for any reason, BitBlockAi will provide you with notice unless a court order or other legal process prohibits BitBlockAi from providing you with such notice. If BitBlockAi decides to take certain measures against you, such as restricting access to your account, suspending your account, or terminating your account, you acknowledge that the decision may be based on confidential criteria necessary for BitBlockAi's risk management and security standards. BitBlockAi is under no obligation to provide you with information regarding its risk management and security policies, and you accept and agree that this is the case.

Account deactivation or cancellation will result in your inability to transfer Digital Currency or funds associated with your Hosted Digital Currency Wallet(s) and/or your USD Wallet(s), except as required to do so I by law, including but not limited to applicable sanctions programs or (ii) by a facially valid subpoena or court order, as applicable. You will not be charged for canceling your BitBlockAi Account(s), but you will be liable for any outstanding sums owed to BitBlockAi after your cancellation. You are not permitted to enable us to cancel or suspend any outstanding transactions at the time of the cancellation.

7.8. The death of the account holder. Because of security concerns, we will freeze your BitBlockAi Wallet if we receive legal documentation confirming your death or other information that leads us to believe you have died. Transactions will not be permitted until either: I your designated fiduciary has opened a new BitBlockAi Wallet, as described further below, and transferred the entirety of your BitBlockAi Wallet to such new account, or (ii) we have received proof in a form that we deem satisfactory If we have reasonable grounds to believe you have died but do not have sufficient evidence to support our suspicions, you authorize us to make any investigations, directly or via third parties, that we feel necessary to ascertain the circumstances of your death. If you have passed away, we will need the fiduciary you have designated in a valid Will or comparable testamentary instrument in order to establish a new BitBlockAi Account following receipt of documents that is acceptable to us proving your death. In the event that you have not designated a fiduciary, we reserve the right to either I treat as your fiduciary any person entitled to inherit your BitBlockAi Account, as determined by us upon receipt and review of any documentation we, in our sole and absolute discretion, deem necessary or appropriate, including (but not limited to) a Will, a living trust, or a Small Estate Affidavit, or (ii) request an order designating a fi The right to seek a resolution order from a court of competent jurisdiction prior to taking any action with respect to your BitBlockAi Account remains reserved in the event that we determine, in our sole and absolute discretion, that there is a question about the legality of the fiduciary designation has arisen. Accordingly, you acknowledge and agree that, in the event of the death of a BitBlockAi wallet holder, your designated fiduciary will be required to open a new BitBlockAi Wallet and provide all information required under Section 2 of this Agreement in order to gain access to your BitBlockAi Wallet's contents.

7.9 Unclaimed property is property that has not been claimed. Following a period of time during which BitBlockAi is unable to reach you or retains records of your usage of the Services, relevant law may compel BitBlockAi to submit these money (including fiat currency and Digital Currency) to the appropriate jurisdiction as unclaimed property. If this occurs, BitBlockAi will make every effort to contact you at the address shown in our records; but, if BitBlockAi is unable to reach you, it may be required to forfeit any unclaimed funds to the relevant state or government.

7.10 The Relationship Between the Parties BitBlockAi is a fully independent contractor that works on your behalf. The terms and conditions of this Agreement shall not be considered or interpreted in such a way that you and BitBlockAi are deemed to be partners, joint venturers, or otherwise as joint associates for profit, or in such a way that either of you or BitBlockAi is deemed to be the other's agent.

7.11. The Confidentiality of Other People's Information; Marketing if you get personally identifiable information about another user via the BitBlockAi Services, you are required to keep the information confidential and to use it exclusively for the purpose of delivering the BitBlockAi Services. The information about the user may not be disclosed or used for any purpose other than to complete a transaction and provide associated services such as support, reconciliation, and accounting unless the user has given his or her express consent to such disclosure or use. When utilizing the BitBlockAi Services, it is not permissible to send an unsolicited email to a user who has not explicitly requested to receive it.

7.12. Security of Passwords; Providers' Contact Information You are solely responsible for creating a secure password, safeguarding and controlling any IDs, passwords, hints, personal identification numbers (PINs), API keys, and any other codes that you use to access the BitBlockAi Services, and for any consequences arising from the unauthorized use of your credentials. Third-party access to your BitBlockAi Account(s), as well as the loss or theft of any Digital Currency and/or funds stored in your BitBlockAi Wallet (s) and any associated accounts, including your linked bank account(s) and credit card information, may result from the loss or compromise of the foregoing information and/or your personal information (s). To ensure that you get any cautions or notifications from us, you must ensure that your email address and telephone number in your Account Profile are up to date and accurate. Within seven days of creating their wallet, all investors must provide identity to the wallet administrator. The failure to verify your identity will result in a KYC SECURITY IDENTIFICATION VERIFICATION FEE, which will be disclosed to you based on the type of cryptocurrency contract you are running, or the requirement to wait a minimum of one month after your Smart Hodl or Staking ends in order for the KYC SECURITY IDENTIFICATION PROCESS TO BE COMPLETED before completing the withdrawals procedure procedure. Enabling remote access or screen sharing while logged into your BitBlockAi Account is not recommended. No information about your password or two-factor authentication will ever be requested by BitBlockAi. In the event that your account login credentials are compromised via no fault of BitBlockAi's, and/or you fail to comply with or act on any messages or alerts we may provide to you, we will not be liable for any damages you may suffer as a consequence of this. Immediately notify BitBlockAi Support at Contact Support if you feel your BitBlockAi Wallet(s) information has been compromised.

7.13. Taxes and fees However, it is not exclusively your responsibility to determine if and to what extent any taxes are applicable to any transactions you do using the BitBlockAi Services, as well as to withhold, collect, and transmit the required tax amounts to the appropriate taxing authorities. Tax is cleared after the Staking or Smart Hodl plan is completed. Your BitBlockAi Wallet allows you to see your transaction history at any time(s). 

7.14. Advisory or brokerage services in the field of investment This is important to understand since BitBlockAi is not a broker and does not provide investment, tax, or legal advice on your behalf. Unless otherwise specified in your order instructions or in accordance with posted Trade execution procedures, all BitBlockAi trades are executed automatically. You are solely responsible for determining whether any investment, investment strategy or related transaction is appropriate for you in light of your personal investment objectives, financial situation, and risk tolerance before entering into a transaction. If you have any questions about your specific situation, you should consult with an attorney or tax consultant. When it comes to supported digital currencies as well as digital currencies that BitBlockAi does not support, BitBlockAi may provide instructional information to assist users in learning more about such digital currencies. Blog entries, articles, links to third-party content, news feeds, tutorials, and videos are examples of the sorts of information that may be included. The information included on this website or on any third-party websites does not constitute investment advice, financial advice, trading advice, or any other kind of advice, and you should not interpret any of the website's content as such, and you should refrain from doing so. Purchasing, earning, selling, or holding any Digital Currency is not recommended by BitBlockAi, nor is it endorsed by the company. Preparing for the purchase, sale, or holding of any Digital Currency should include doing your own due diligence and consulting with your financial professionals. BitBlockAi will not be accountable for any purchases, sales, or holds of Digital Currency that are made in reliance on the information provided by BitBlockAi or any other source.

 

8. Customer feedback, inquiries, complaints, and dispute resolution are all handled via this channel.

8.1. Connect with BitBlockAi through the internet at step 8. Send us an email at Contact Support if you have any questions, comments, or general requests about our products or services. Whenever you contact us, please provide your full name and mailing address, as well as any other information that will allow us to identify you, your BitBlockAi Wallet(s), and the transaction about which you have questions or complaints.

If you believe your account has been hacked, you may also file a claim with the company. Unless otherwise specified, all legal documents, including civil subpoenas, complaints, and small claims, must be served on BitBlockAi's registered agent for service of process, which is located in the United Kingdom. We would like to point out that our registered agent will accept service only if the entity named as the receiver of the document is similar to the entity registered with the Secretary of State and permitted to accept service by our registered agent. Please keep this in mind when submitting documents to us. BitBlockAi does not relinquish any legal objections it may have to a legal document just because it has been served with the document.

8.2 The Procedure for Filing a Formal Complaint (in English). Whenever you have a dispute with BitBlockAi (a "Dispute"), you agree to communicate with BitBlockAi via our customer care team in order to attempt to reach a mutually agreeable solution. If we are unable to resolve an issue via the BitBlockAi support team, you and we both agree to go through the formal complaint process outlined below. You acknowledge that you have read and understand this process before filing any arbitration or small claims claim. Unless and until you comply with the procedures outlined in this Section prior to submitting an arbitration claim or small claims court action, we reserve the right to request that your filing be rejected by the arbitrator or small claims court, unless and until you comply with the procedures outlined in this Section.

8.2.1. Steps in the Procedure If your dissatisfaction with BitBlockAi is not resolved through your contact with BitBlockAi Support, you agree to use our Whatsapp or Telegram customer service page to detail your Complaint, how you would like us to handle it, and any other information you believe is relevant to your dispute with the software.

8.2.2. Response from BitBlockAi. We will acknowledge receipt of your Complaint form after it has been submitted. Your Complaint will be examined by a customer support representative from BitBlockAi within 48 hours ("Agent"). The Agent will investigate your Complaint based on the information you provide as well as the information in the possession of BitBlockAi. Following receipt of your Complaint form, the Agent will respond to the issues raised in your Complaint form via email ("Resolution Notice"), in which the Agent will: I offer to resolve your complaint in the manner requested; (ii) reject your complaint and explain why; or (iii) offer to resolve your complaint in a different manner than that which was originally requested. If the Agent is unable to respond to your Complaint within 15 business days for reasons beyond BitBlockAi's control, the Agent will send you a communication explaining the reason for the delay and specifying the deadline by which the Agent will respond to your Complaint, which will be no later than 35 business days from the date we receive your Complaint form. In exceptional circumstances, if the Agent is unable to respond to your Complaint within 15 business days for reasons beyond BitBlockAi' 

 

8.3 Upgrade Deposit for wallet performance percentage. In order to participate in any Basic investment plans (1 month), a weekly hashrate upgrade deposit equal to 50% of the initial investment amount is required. In order to upgrade to the Premium (3-month plan) and Platinum (6-month plan), monthly payments of 25% are necessary for the first three months. In order to participate in the customizable (1 year plan) investment choices, you must pay a 15 percent hashrate upgrade deposit every three months. All wallet investment plans created with a PROMO code operate for a minimum of three months and require a monthly hashrate upgrade deposit of 20 percent of the initial investment capital when a PROMO code is utilized.

8.4 Arbitration and Waiver of Class Actions We agree that, if we are unable to resolve a dispute through the Formal Complaint Process, we will resolve any dispute arising out of or relating to this Agreement or the BitBlockAi Services through binding arbitration on an individual basis. This includes claims based on federal or state statutes, common law, contract, tort (including negligence), fraud, misrepresentation, or any other legal theory (the "Arbitration Agreement"). Subject to applicable jurisdictional restrictions, you may opt to pursue your claim in small claims court rather than arbitration if your case remains in small claims court and is conducted on an individual (rather than a class or representative) basis. For consumer-related issues, the arbitration must be conducted in accordance with the rules established by the Belgian Arbitration Association.

This Arbitration Agreement applies to any and all disputes arising out of or pertaining to the interpretation or implementation of the Arbitration Agreement, including disputes over the Arbitration Agreement's enforceability, revocability, scope, or validity, among other things.

ANY AND ALL CLAIMS MUST BE Brought in an individual capacity, and not as a plaintiff or as a member of any purported class, collective, or representative action or proceeding, to the fullest extent permissible under applicable law (COLLECTIVELY THE "CLASS ACTION WAIVER"). No more than one person may file a claim with the ARBITRATOR, and no more than one person may participate in any kind of class arbitration. BY ACCEPTING THESE TERMS, YOU AND BitBlockAi AGREE that you and BitBlockAi are waiving the right to a trial by jury as well as the right to participate in a class action.

It will be performed in the English language by a single impartial arbitrator and will take place in the county or parish where you reside, or at another location that has been mutually agreed upon by both parties. Arbitrators have the authority to award any remedy that a court of competent jurisdiction would provide, and their judgments may be enforced in any court of competent jurisdiction. A decision and judgment given by an arbitrator have no presidential or collateral estoppel impact on the parties to the arbitration. If you want, you may have your hearings in person or over the phone, and the arbitrator can arrange for the filing and adjudication of motions on briefs, which eliminates the need for oral hearings altogether. A successful party in any action or procedure to enforce this Agreement, in any arbitration conducted in connection with this Agreement, or in any small claims action shall be entitled to recover costs and attorneys' fees to the extent permitted by law. You are responsible for any filing fees or other administrative expenditures imposed by the arbitrator or arbitration administrator; however, we will reimburse you to the extent that these fees or costs exceed the amount you would be required to pay in court. Also included are any additional costs or charges imposed by the arbitration administrator's rules or by applicable law, which we will pay.

 

9. Requirements that are general in nature

9.1 Viruses on Computers.  We expressly disclaim any responsibility for any damage or interruptions caused by computer viruses or other malicious code that may infect your computer or other equipment, or by any phishing, spoofing, or other kind of attack on your computer. We suggest that you use a virus screening and prevention software on a regular basis, and that you pick one that is reliable and widely available. Additional warning: SMS and email services are vulnerable to spoofing and phishing efforts, so use care when considering messages that seem to originate from BitBlockAi or its affiliates. If you have any questions regarding the authenticity of any communication or notice, you should always visit your BitBlockAi Account(s) via the BitBlockAi Site to examine any transactions or essential activities.

9.2. The publication of BitBlockAi and the indemnification of the author You agree to indemnify and hold harmless BitBlockAi, its affiliates and service providers, and each of their respective officers, directors, agents, joint venturers, employees, and representatives against any and all claims, demands and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes. BitBlockAi reserves the right to take action against you if you violate any of the terms of this agreement. Indemnify and hold harmless BitBlockAi, its affiliates, and Service Providers, as well as each of their officers, directors, agents, joint venturers, employees, and representatives, against any claim or demand (including attorneys' fees and any fines, fees, or penalties imposed by any regulatory authority) arising out of or related to your breach of this Agreement, or your violation of any law, rule, or regulation, or the rights of a telecommunications service provider or other third party

9.3 The limitation of liability and disclaimer of warranties are discussed in detail in Section.  This means that if you claim that BitBlockAi failed to properly process a purchase or sale transaction, you will not be entitled to any compensation in excess of the value of the supported digital currency on deposit in your BitBlockAi account.

ADVICE AND SERVICES PROVIDED BY BitBlockAi ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. In order to the fullest extent permitted by law, BitBlockAi expressly disclaims any and all implied warranties including but not limited to the warranties of title, merchantability, fitness for a particular purpose, and/or non-infringement of intellectual property rights. No representations or warranties are made by BitBlockAi that access to the Site, any part of the BitBlockAi Services, or any materials included within will be continuous, uninterrupted, timely, or error-free. Broadcasting static miner (BitBlockAi) makes no representation or warranty as to whether any order will be executed, accepted, recorded, or that it will remain open. SUBJECT TO THE EXPRESS STATEMENTS IN THIS AGREEMENT, YOU AGREE THAT YOU have not relied on any other statement or understanding, whether written or oral, with respect to your use and access to the BitBlockAi SERVICES OR the BitBlockAi SITE, and that you will not rely on any other statement or understanding. You agree that BitBlockAi is not liable for any losses or damages resulting from or related to (a) any inaccuracy, defect, or omission of digital currency price data; (b) any error or delay in the transmission of such data; or (c) any interruption in any SECURITY SYSTEMS or NETWORKS.

BitBlockAi makes no representations or warranties as to the accuracy, timeliness, or completeness of historical Digital Currency price data on the BitBlockAi Site. However, BitBlockAi offers no guarantees or warranties about the length of time necessary to finish processing requests for electronic debits and credits involving bank accounts, credit cards, and check issuances, which is reliant on a variety of circumstances outside of our control.

9.4 Complete and total agreement. In the case of the subject matter of this Agreement, this Agreement and its accompanying Privacy Policy, E-Sign Consent, and Appendices constitute the entire understanding and agreement between you and BitBlockAi, and supersede all prior discussions, agreements and understandings of any kind (including without limitation any prior versions of this Agreement) and nature between you and BitBlockAi. The section headings in this Agreement are included only for reference reasons and have no bearing on the interpretation or meaning of any of the terms of this Agreement. a.

9.5. Modifications to the original design. We reserve the right to amend or modify this Agreement at any time by posting the amended Agreement on the BitBlockAi Site or by sending the new Agreement to you, in which case the updated Agreement will take effect immediately after publication. If you are dissatisfied with any such change, your sole and exclusive remedy is to cease using the Services and cancel your account with the Company. In the event that the BitBlockAi Services are modified or terminated, or if your access to the BitBlockAi Services is suspended or terminated, you agree that, except as expressly provided above, we will have no liability to you or any third party as a result of such modifications or terminations. If the modified Agreement involves a significant change, we will make reasonable efforts to inform you through our website and/or email prior to the change taking effect.

9.6. The assignment. It is not permissible for you to transfer any of the rights and/or licenses granted to you under this Agreement to anyone else. Any BitBlockAi affiliates or subsidiaries, as well as any successor in interest to any entity connected with the BitBlockAi Services, will be able to transfer their rights without limitation to us. It shall be null and void any attempted assignment or transfer that is made in violation of the provisions of this section. Unless specifically stated otherwise, this Agreement will bind and insure the parties, their successors, and permitted assigns.

9.7 In the event that any provision of this Agreement is found to be invalid or unenforceable under any rule, law, or regulation of any local, state, or federal government agency that has jurisdiction over the matter, such provision will be changed and interpreted to accomplish the provision's objectives to the maximum extent permitted by applicable law, without affecting the validity or enforceability of any other provision of this Agreement.

9.8 Controlling Change is number nine on the list. The information we have collected from you may be transferred or assigned if BitBlockAi is acquired by or merges with a third-party firm as a result of a merger, acquisition, or sale of all or part of our business.

9.9: Sustaining one's health. In the event that this Agreement is terminated or expires, all provisions of this Agreement that are intended to survive such termination or expiration will survive, including without limitation, sections relating to suspension or termination, BitBlockAi Wallet cancellation, debts owed to BitBlockAi, general use of the BitBlockAi website, and disputes with BitBlockAi.

9.10. The Law That Applies. In the absence of federal law, you agree that this Agreement and any claim or dispute that has or may arise between you and BitBlockAi shall be governed by the laws of the State of California, without giving effect to any principles of conflict of laws. BitBlockAi is a California corporation.

9.11. The Extenuating Circumstances clause is defined as follows: Any delays, failures to perform, or interruptions of service caused directly or indirectly by any cause or condition beyond our reasonable control, including but not limited to significant market volatility, any delay or failure caused by an act of God, civil or military authorities, terrorists, civil disturbance, war, strike or other labor dispute, fire, interruption in telecommunications or Internet services, or network provision, shall not be considered a breach of our obligations under this agreement.

9.12. No Waiver of Rights is Permitted under any circumstances. As a result of this agreement, you will not be considered to have waived any rights that are not waivable under the applicable state money transfer laws in the state in which you live.

APPENDIX 1: Restricted Businesses, Restricted Uses, and Restricted Businesses

Use of your BitBlockAi Wal(s) for the following sorts of activities is strictly prohibited: ("Prohibited Uses"). We would be happy to assist you. By registering for a BitBlockAi wallet, you promise that you will not use it for any of the following activities:

• Any activity that violates or assists in the violation of any law, statute, ordinance, or regulation administered in countries where BitBlockAi does business, including but not limited to the Office of Foreign Assets Control ("OFAC") of the United States Department of Treasury, or that involves the proceeds of any unlawful activity; the publication, distribution, or dissemination of any unlawful material or information; any activity that involves the proceeds of any unlawful activity

• Any action that places an unreasonable or disproportionately large load on our infrastructure, or that negatively affects, intercepts, or expropriates any system, data, or information; transmits or uploads any material to the BitBlockAi Site that contains viruses, trojan horses, worms, or any other harmful or deleterious programs; attempts to gain unauthorized access to the BitBlockAi Site, other users' BitBlockAi A, computer systems, or other networks; violates

• Users may not defame, abuse, extort, harass, stalk, threaten, or otherwise violate or infringe the legal rights of others (including but not limited to the rights of privacy and publicity); incite, threaten, facilitate, promote, or encourage hate, racial intolerance, or violent acts against others; harvest or otherwise collect information from the BitBlockAi Services; or harvest or otherwise collect information from the BitBlockAi Services. • Abuse Other Users:

• The act of deceiving BitBlockAi, BitBlockAi users, or any other person; supplying BitBlockAi with any false, erroneous, or misleading information; and any other act designed to deceive BitBlockAi.

• Sports forecasting or odds-making; fantasy sports leagues that pay in cash; online gaming; contests; sweepstakes; games of chance are all examples of gambling. • Sports betting is another kind of gambling.

• Intellectual Property Infringement: Engaging in transactions involving items that infringe or violate any copyright, trademark, right of publicity or privacy, or any other proprietary right recognized by law, including but not limited to the sale, distribution, or access to counterfeit music, films, software, or other licensed materials without the appropriate authorization from the rights holder; use of BitBlockAi intellectual property, name, or logo, including use of the BitBlockAi logo; and use of the BitBlockAi.

Businesses That Are Prohibited from Operating
The following businesses, commercial operations, and sale of goods are prohibited by BitBlockAi Services in addition to the Prohibited Uses stated above: ("Prohibited Businesses"). Neither Card Network standards nor our financial suppliers or processors require the bulk of the categories of Prohibited Businesses to be in operation. The following list of specific applications is intended to be illustrative rather than exhaustive. We encourage you to contact us at Contact Support if you have any questions or concerns about whether your usage of BitBlockAi Services constitutes Prohibited Business or how these rules apply to you specifically.

If you create an account with the BitBlockAi Services, you agree not to use the BitBlockAi Services in combination with any of the following businesses, activities, practices, or other items:

• Securities brokerage, mortgage consulting or debt reduction services, credit counseling or debt reduction services, real estate opportunities, and investment schemes are some examples.

• Services having limited access include check cashing, bail bonds, and debt collection organizations, among other things.

• Intellectual property or proprietary rights infringement is defined as the sale, distribution or access to unauthorized copies of licensed music, films or software or other licensed things without the explicit agreement of a rights holder.

• Unauthorized sales of brand-name or designer products or services; sales of goods or services that have been illegally imported or exported; or sales of goods or services that have been stolen are all examples of counterfeiting or unauthorized sales.

• Among the regulated products and services are marijuana dispensaries and related businesses, tobacco sales, including electronic cigarettes and e-liquid sales, online prescription or pharmaceutical services, age-restricted goods or services, weapons and munitions, gunpowder and other explosives, fireworks and related goods, toxic and flammable substances, radioactive materials, as well as products and services with varying legal status from one state to another.

• Narcotics and Drug Paraphernalia: This includes the selling of narcotics, controlled substances, and any equipment used in the manufacturing or use of drugs, such as bongs, vaporizers, and hookahs, among other things.

• In the case of pseudo pharmaceuticals, pharmaceuticals and other things that make health claims but have not been approved or validated by the relevant local and/or national regulatory body are considered to be fraudulent.

• Legal substances that have the same effect as illegal drugs: The selling of a legal substance that has the same effect as an illegal substance is known as emulation (e.g., salvia, kratom)

• Pornography and other obscene things (including literature, photos, and other media); websites that provide sexually explicit services such as prostitution, escorts, pay-per-view, and adult live chat features; and pornographic and other obscene materials (including literature, photographs, and other media).

• In addition to pyramid frauds and network marketing systems, there are other types of referral marketing as well.

• We will prohibit the following practices: investment opportunities or other services that promise high returns without providing additional value to the buyer; the sale or resale of services that do not provide additional value to the buyer; the resale of government offerings without authorization or added value; and websites that we deem to be unfair, deceptive, or predatory toward consumers in our sole discretion.

Payment intermediaries and aggregators, as well as any other resale of BitBlockAi Services are prohibited. • Money Services: Money transmitters, Digital Currency transmitters, currency or Digital Currency exchanges or dealers, gift cards, prepaid cards, sale of in-game currency, unless the merchant is the virtual world's operator, and the sale of in-game currency are prohibited.

Donations to charity organizations are accepted by philanthropic organizations.

In accordance with the provisions of this Agreement and relevant law, skill games are games that do not constitute gambling, but which charge an entry fee and provide a prize in exchange for participation.

APPENDIX 2: Verification Procedures and Restrictions on Their Use
